Isha Pay is a complete solution for all your needs which has Mobile Recharges, DTH Recharges, Bill Payments, Rental Payments, Fastag Recharges, Money Transfer, Insurance Premium, Loan EMI, Gas Cylinder booking and many more in one Application. To use our various facilities & services we have certain terms and conditions to be followed by the users. Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading, or using the Isha Pay app.

THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF THE INFORMATION TECHNOLOGY ACT, 2000 AND RULES MADE THEREUNDER. THIS ELECTRONIC RECORD IS GENERATED BY A COMPUTER SYSTEM AND DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES.

By using our website or the services means you should be bound by our terms and conditions and without any hesitation you can use our services at any time and from anywhere but, any point of time if you don't want to be abound by our terms and conditions then you can stop using our services and stop visiting our website or you can permanently terminate our services and website with your choice.

Definetion & Interpretation

The Terms and Conditions (as may be amended from time to time) is a legal contract and an agreement between you, an individual customer, member, user, or beneficiary of this service must have above 18 years of age ("You"), and Isha Pay (together with its subsidiaries and other affiliates, "us", "we", "Isha Pay"), regarding Your use of our prepaid mobile/DTH recharge services (known as "Service") to purchase prepaid mobile/DTH recharge (known as "Recharge") and related services on our website "www.Isha Pay.co.in" (known as the "Site"). If you use any of the services provided by us through our app, you shall be exposed to the rules, guidelines, policies, terms, and conditions applicable to specific services, and they shall be deemed to be incorporated into this Terms & Conditions. We reserve the right to change, modify, add or remove portions of these Terms & Condition, at any time without any prior intimation. It is your responsibility to review the Terms & Condition periodically for updates or changes. Your continued use of the website, authenticate that you accept and agree to the modifications or changes done by us.

Eligibility

Isha Pay app is not eligible to have contract with a minor, unsound or intoxicated person is void, as they are incompetent to contract. By accessing our Isha Pay Services, You represent that You above 18 years of age and have not been previously suspended or removed by Isha Pay, or disqualified for any other reason, from availing the Isha Pay Services. In addition, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the Terms & Conditions as part of this Agreement. Finally, you shall not impersonate any person or entity, falsely state or misrepresent your identity, age, or affiliation with any person or entity. Finally, in the event of any violation of the Terms & Conditions, Isha Pay has the right to suspend or permanently prevent you from availing of service.

Responsibility

Isha Pay provides you all the service in a single platform so you will be responsible to maintain the confidentiality of your Display Name, Password, contact number, E-mail address, etc. your personal details is important to us-to give you best service, to contact you regarding the service to avail from us. We promise to secure your personal details provided to us. You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms & Conditions, We shall have the right to indefinitely suspend or block access of your membership on the website and refuse to provide You with access to the Website. It is your responsibility to ensure that your mobile phone number and your email address are up to date on the app at all times. You agree to notify us promptly if your mobile phone number or e-mail address changes by updating the same on the app through One Time Password verification. If You share or allow others to have access to Your account on the your account, by creating separate profiles under your Account, or otherwise, they will be able to view and access Your Account information. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences there from.

Intellectual property rights

The Website and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork and computer code (collectively, the "Content") on the app is owned and controlled by Isha Pay or its licensors and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights. Through Your use of the Website, by no means are any rights impliedly or expressly granted to you in respect of such Content. Isha Pay reserves the right to change or modify the Content from time to time at its sole discretion. The trademarks, logos, and service marks displayed on the app and website ("Marks") are the property of Isha Pay or their vendors/seller or respective third parties. You are not permitted to use the Marks without the prior consent of Isha Pay, the vendor/seller, or the third party that may own the Marks. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Isha Pay owns all intellectual property rights to and into the trademark "Isha Pay", and the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, databases, text, content, graphics, icons, and hyperlinks. Except as expressly provided herein, you acknowledge and agree that you shall not copy, republish, post, display, translate, transmit, reproduce or distribute any Content through any medium without obtaining the necessary authorization from Isha Pay or third party owner of such Content.

Communication

When you use Services provided by Isha Pay send Text messages, Email, Voice call or any other communication mode will be electronically recorded by our end for quality purpose. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Isha Pay, such as our Message Center, and you can retain copies of these communications for your records. If any misconduct or any violation of the Terms & Conditions, Isha Pay has the right to suspend or permanently prevent you from availing of service in the Isha Pay Application.

Disclaimer of Warranties and Limitations of Liabilities

To the full extent permissible law, Isha Pay and its third-party partners disclaim all warranties or guarantees – whether statutory, express, or implied – including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by you from Isha Pay or through Isha Pay Services will create any warranty or guarantee other than those expressly stated herein. For the purposes of this Disclaimer, You expressly acknowledge that as used in this section, the term “Isha Pay” includes Isha Pay officers, directors, and employees. You acknowledge that Isha Pay user. The Isha Pay services and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the Isha Pay services are provided by Isha Pay on an "as is" and "as available" basis unless otherwise specified in writing. Isha Pay makes no representations or warranties of any kind, express or implied, as to the operation of the Isha Pay services, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the Isha Pay services unless otherwise specified in writing. You expressly agree that your use of the Isha Pay services is at your sole risk. It is your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, merchandise, and other information provided through the site or on the Internet.

Third Party Links:

Isha Pay is not liable for any harm or damages related to the use of services, content, resources and other transactions made in connection with the third party websites. Please review before proceeding third party policies and make sure you understand them before you engage in any transaction. Claims, Questions, Complaints and concerns regarding third party products should be directed to the third - party. Our website may contain some materials from third parties. Those links on the website may direct you to third party websites which are not under Isha Pay.

About Warranty and Representation:

This Terms and Conditions constitutes a legal, valid and binding obligation of yourself in using the service. All the payment transactions using the service are lawful, genuine and valid; these do not promote any illegal or unlawful activities.

All the details provided to Isha Pay by you is (at the time of registration) accurate, genuine in all percepts and you will not omit or withhold any information which makes it inaccurate in all respects.

If you provide your financial information to Isha Pay means that may reasonably be required for the company. Isha Pay is not liable for any damage, loss, injury, claim, any direct, indirect, incidental, special and any kind of lost profits, revenue, lost savings, loss of data or any kind of losses or damages in any scenario.

Isha Pay has the right to take action for unauthorized transactions and fraudulent transactions and suspicious transactions at any time.

Indemnity:

You agree to defend, hold harmless, indemnify our company and its agents, managers, subsidiaries and other affiliates companies, staff members, officers, directors, contractors and directors from and against any and all damages, obligations, claims, liabilities, losses, debt or costs and expenses arising out of related to your use of services including data transmitted and received by you and your violation of any of these Terms and Conditions, third party rights, any applicable law, rule or regulation and negligent or willful misconduct and the use of service with your unique username and password.

Additional Disclosures:

No waiver by either you or our company of any type of transactions like failure, default any right allowed under this agreement. The section headings used herein are for our convenience only and shall be of no legal force or effect. If any portion of this agreement is held invalid by a court or any jurisdiction such invalidity shall not affect the enforceability of any other provisions contained in this agreement and the remaining portion of our agreement shall continue in full force and effect.

 

Non-Acceptable Use/Restricted/Prohibited:

You agree not to engage or use the services

  • To provide yourself or any other person with a cash advance.
  • Money laundering and financing terrorism
  • Any other purpose other than paying for bill payment services.
  • To submit false or misleading information.
  • For any obscene or immoral purpose
  • Spam, pretext, spider, crawl, phis or scrape
  • Other than legitimate payment purposes.
  • Payments such as mortgages and personal loans.
  • For gambling and related activity
  • Other goods and services subject to government regulations.
  • False information submission, committing fraud or falsifying information in connection with your account or in order to create multiple accounts.
  • Logging into a server or an account which you are not authorized to access.
  • For tampering or interfering with the proper functioning of any part of the site and all functions and services provided by us.
  • Attempting to scan, test the security, configuration of the site or to breach security or authentication measures without proper authorization.
  • For disseminating or transmitting material that to a reasonable person may be considered abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, malicious or threatening.
  • Taking any action that may cause us to lose any of our services from our internet service providers, payment processor, and other suppliers.
  • Intentionally or unintentionally violating any applicable laws, ordinance, statute, rules, regulations or code including but not limited to any rules and regulations, instructions or directives of any regulatory body or authority or other securities exchange.
  • For engaging in any other activity deemed by us to be in conflict with the spirit or intent of this agreement.
  • To send automated requests of any kind to the website's system without permission in advance from IshaPay.
  • With the help of any miscellaneous device attempt to interfere with the services.
  • Involve in selling the service or information or software associated with or derived from the website.
  • If you are under the age of 18 then you should be under your parental sponsor.
  • That could be damage, disable, overburden or impair it, including without limitation using the services in an automated manner.
  • Intentionally interfere with the functionality or cause damage to the operation of the services.
  • Collect user’s personal information and financial information



 

Payment

Isha Pay gives many services like rent payments, rent advances, utilities & bill payments, maintenance, and other bill payments and recharges as specified on the website from time to time. Users should agree all the terms and conditions and take full responsibility for the transactions made on the online platform while doing transactions like beneficiary name, a/c num, tax implications if any Isha Pay and its payment partners act as mere facilitators of authorized payments and shall not be assume responsibility nor liability for any unauthorized payments or transactions done by you.

Isha Pay further reserves the full right to suspend/ hold/ refund and report to those payments which are unauthorized and suspicious in nature with respect to bank concerns.

Isha Pay may charge users certain fees for accessing our Website and Services as a whole, or certain features of the Website/Services. You agree to pay any such fees, as may be applicable to the Services that you use. All payments made against the purchases/services on application by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transactions with respect to any other form of currency with respect to the purchases made on. Isha Pay will try to ensure that you are made aware of the applicability of any fees for a particular use of the Website/Services, as well as the number of fees payable by you for any such use of the Website/Service. You agree that Isha Pay may, at any time, charge, modify or waive fees required to use the Website. Your continued use of the Website/Services after such change in the fees will be considered to be your acceptance of such changes, and the applicability of these Terms of Use to such changes.

Before shipping/delivering your order to you, the Seller may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users. And also you agree to provide correct and accurate financial information, such as credit/debit card details to the approved payment gateway or pre-paid payment instrument account details or net banking or UPI account details for availing Services on the app. You shall not use the credit/debit card or pre-paid payment instrument or net banking details or UPI ID which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/debit card or pre-paid instrument account or net banking account or UPI ID. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation, or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of your credit/debit card details or pre-paid instrument account or net banking details or UPI ID. Isha Pay expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card or pre-paid instrument account. You, as a Buyer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier. In case you do not raise a refund claim using Isha Pay features within the stipulated time then this would make you ineligible for a refund as well as understand that the Payment Facility may not be available in full or in part for certain category of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services

Account

You may need your own Isha Pay account to use certain Isha Pay Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You will be responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Immediately notify Isha Pay of any unauthorized use of Your Account Information or any other breach of security, and ensure that you exit from Your Account at the end of each session. Isha Pay cannot and will not be liable for any loss or damage arising from your failure to comply with this section. You may be held liable for losses incurred by Isha Pay or any other user of or visitor to the Website due to the authorized or unauthorized use of Your Account as a result of your failure in keeping Your Account Information secure and confidential.

Disputed Transactions:

All users should be bound with terms and conditions of Isha Pay. If any user violating this or our payment partners Isha Pay reserves the right to hold back that amount which is suspicious or unauthorized. In case of any fraudulent transactions Isha Pay reserves the right to take an appropriate action in accordance with the agreed terms of use. then that user should provide appropriate documents for validation of that transactions otherwise if the user is unable to furnish that documents then Isha Pay reserves the right to refund the transaction amount to the source account after deduct the charges incurred that includes convenience fee, PG charges, Service Tax or GST and other related charges.

Isha Pay further reserves the right to hot-list any user account if the same is found to be violating Terms and Conditions of our website and also right to report the details to the concerned authorities of bank partners for further action.

Arbitration

Isha Pay may elect to resolve any dispute, controversy, or claim arising out of or relating to this agreement or service provided in connection with this agreement by binding arbitration in accordance with the provisions of the Indian Arbitration & conciliation act, 1996. Any such dispute, controversy, or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Hyderabad India and judgment on the arbitration award may be entered in any court having jurisdiction thereof. All administrative fees and expenses of an arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own lawyers and preparation. The language of the arbitration shall be English.

Termination:

We may terminate or update these Terms and Conditions at any time or suspend access to the entire site immediately without any prior notice or liability, if you breach any terms of this agreement for any reason. Without intimating you, we shall have the right to immediately terminate or suspend your account.

Cancellation & Refund Policy

Recharges and Bill Payment Refund Policy

All Sales of Prepaid and DTH Recharge are final and there will be no refund or exchange permitted. Please be advised that You are responsible for the mobile number or DTH account number you purchase Recharge for and all charges that result from those purchases. Isha Pay is not responsible for any purchase of Recharge for an incorrect mobile number or DTH account number.

However, in a case where a transaction has been completed by you on the Site/App, and money has been charged to your card or bank account but a Recharge has not delivered within 24 hours of your completion of the transaction then you may inform us by sending us an email on support@Isha Pay.co.in or Raise a Ticket on the Support page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - The Mobile number or DTH account number, Consumer Number, Operator Name, Transaction Value, Transaction Date, and Order Number, Isha Pay shall investigate the incident and if it is found that money indeed charged to your card or bank account without delivery of Recharge/BBPS transactions then you will be refunded the money within 5 to 7 working days from the date of the receipt of your email.

For cases, if you are doing Recharge / Bill Payment from your Isha Pay the account balance and you have received a success confirmation but not received a Recharge / Bill Payment or any other case you are welcome to log a complaint by opening a support ticket on Support Page or mail us on support@Isha Pay.co.in we will provide you quick resolution.

THERE IS NO REFUNDS OR REVERSAL OF ANY KIND FOR SUCCESSFUL TRANSACTION.

However, users will get refund in case of any failure transactions due to technical issues on the website. In such cases, the user shall be refunded full amount including service fees (if any), without any cutting into his account within 7-10 working days.
